UpAction public offer
This document is a public offer by FOP Mazepa N.V. (sole proprietor) (the "Provider") to conclude a contract for access to the UpAction app on the terms below.
1. Acceptance
You accept the offer by registering in the app and/or by starting and paying for a Pro subscription. From that moment the contract is concluded.
2. Subject
The Provider gives the user access to UpAction: a free plan and the paid Pro subscription. The terms of the subscription, auto-renewal, cancellation and refunds are in the separate document "Pro subscription and auto-renewal terms", which is an integral part of this offer.
The app is meant for building habits; it is not a medical service and does not replace a doctor's advice.
3. Rights and duties
The user gives a valid e-mail, does not pass access to third parties and uses the app lawfully. The Provider keeps the service available, announces material changes and protects the user's data.
4. Liability
The service is provided "as is". The Provider is not liable for interruptions caused by circumstances beyond its control. Liability is limited to the amount paid for the current period to the extent the law allows.
5. Term and termination
The contract is open-ended. The user can stop using the service and delete the account at any time. The Provider may restrict access if the terms are broken.
6. Disputes and details
